Newsstand Fact Sheet

Thank you for considering an application to operate a newsstand in New York City. JCDecaux Street Furniture New York, LLC ("JCDecaux") is New York City's street furniture franchisee through a contract it holds with the New York City Department of Transportation ("NYC DOT"). It is the company that fabricates, installs and owns the newsstands in which licensed operators conduct their business. The following is information regarding details about the newsstands:

  1. You must pay a portion of construction/installation costs of the newsstand. The total amount that must be paid (which is only a fraction of the total cost of the construction/installation of a newsstand) is $33,955.57 for 2020 (this amount does not include any application or architect fees).
  2. The loan with JCDecaux is separate from the licensing requirements from the New York City Department of Consumer Affairs ("NYC DCA").
  3. Ownership of the newsstand structure always remains with JCDecaux. Operators do not ever own the newsstand structure. The payment to JCDecaux is to pay a portion of the construction and installation; it does not result in ownership of the newsstand.
  4. Your portion of the cost of the newsstand may be paid in full to JCDecaux or via an installment plan over a term of 5 years (subject to timeline described in point #5 directly below)
    1. If you choose to pay in installments, a promissory note, which specifies that a loan is being made, must be signed with JCDecaux and the following applies:
      1. You must pay a $10,000 deposit within 15 days of receipt of the "new location letter" from JCDecaux. The letter will be sent to you once JCDecaux is informed by DOT that your newsstand location has been approved by the Public Design Commission.
      2. The interest rate is prime plus 1%
      3. The monthly payment amount with interest as of the date of this document is approximately $550/month
  5. It takes approximately 6 months from the time you apply for a newsstand with the NYC DCA to the time that JCDecaux is notified of the newsstand. Due to certain provisions in JCDecaux's contract with NYC DOT, if JCDecaux is notified of your newsstand between June 24, 2020 and June 24, 2021 and you choose to pay JCDecaux via an installment plan, your monthly payments will begin 30 days after you have paid your deposit (i.e. before your newsstand is installed). Please note, payments are due regardless of whether you have received a license from the NYC DCA.
  6. Due to certain provisions in JCDecaux's contract with NYC DOT, if JCDecaux is notified by NYC DOT that your location has been approved by the Public Design Commission after June 24 2021, JCDecaux is not permitted to loan the cost of the newsstand and you must pay the full amount of $33,955.57 up front.
  7. Once you have made a payment to JCDecaux (either a deposit payment or a payment in full), JCDecaux may conduct a "pit test" to ensure that the underground conditions at your chosen location can support a newsstand structure.If the pit test determines that the site is not viable, the money you paid to JCDecaux will be refunded to you via check
    1. If the pit test determines that the site is able to support a newsstand structure, JCDecaux will order the newsstand. It takes as long as seven months to manufacture the newsstand

  8. Installation and connecting the newsstand to electricity can take an additional 6-12 months after the newsstand is manufactured. The process to power up the newsstand with ConEdison is a multi-step process and JCDecaux does not have any control over ConEdison timelines.
  9. Once the newsstand passes the final inspection by Con Edison, DOT will inspect the newsstand.
  10. Keys will not be released to you unless (1) you have been issued a license from DCA and (2) your account is paid up-to-date
  11. You will be responsible for your loan payments regardless of whether you maintain a license with NYC DCA. You will be responsible for your loan payments throughout the duration of your loan term regardless of whether you remain in business at your newsstand location. If you do not remain up-to-date on your payments to JCDecaux, you will receive a default notice and will be given ten days to bring your account up-to-date. If you do not bring your account up-to-date within ten days, JCDecaux may accelerate the loan and demand full repayment of the remaining balance immediately. Additionally, the loan may be turned over for collection and you will be responsible for reasonable legal fees, collection and enforcement charges, in addition to the amount due on your loan.
  12. If you surrender your license and/or go out of business, you will not receive a refund for any amounts you have paid to JCDecaux and you are still liable for repaying the loan.
  13. Once you take possession of your newsstand, you may not make any alteration that requires drilling into any surface of the newsstand on either the interior or exterior of the newsstand.
